General Terms and Conditions (GTC) with customer information
As of: 01 October 20241. Scope
1.1. These General Terms and Conditions (GTC) apply to all orders placed through our online shop. Our online shop is aimed exclusively at consumers. A consumer is any natural person who concludes a legal transaction for purposes that cannot be attributed primarily to their commercial or independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.
2. Contracting parties, conclusion of contract
2.1. The purchase contract is concluded with HANDEL & VERTRIEB (H&V) Fa. Star-Biker, with registered office at Schwimmbadstr. 2, CH-5210 Windisch, Switzerland.
2.2. The placement of products in the online shop represents a binding offer to conclude a contract.
2.3. The contract is concluded when the customer accepts the offer for the goods contained in the shopping cart by clicking on the order button. Immediately after submitting the order, the customer receives a confirmation by email.
3. Contract language, contract text storage
3.1 The language available for concluding the contract is German.
3.2. We save the contract text and send the customer the order data and our general terms and conditions by email. The contract text can also be viewed in the customer login.
4. Delivery conditions
4.1. Shipping costs may be added to the stated product prices. Customers can find out more about the shipping costs in the offers.
4.2. Delivery will be made to the delivery address provided by the customer. Alternatively, the customer has the option of picking up the goods themselves or having them shipped.
5. Payment
5.1. The following payment methods are generally available in our shop: credit card, Klarna, PayPal, instant bank transfer and advance payment by bank transfer.
5.2. When placing the order, the customer simultaneously submits his credit card details or is redirected to the website of the online provider PayPal. If the payment method Klarna or Sofortüberweisung is selected, the customer is redirected to the respective website of the payment service provider.
6. Cancellation policy
6.1 Customers within Switzerland have the right to withdraw from this contract within fourteen days without giving any reason.
6.2. The cancellation period shall be fourteen days from the day on which the customer or a third party other than the carrier designated by him takes possession of the goods.
6.3 However, the right of withdrawal only applies if the goods are unopened and in unused condition.
6.4 The right of withdrawal does not apply to customers outside Switzerland.
7. Returns & refunds
7.1 The customer has the right to cancel his order within fourteen days without giving any reason, provided that the goods are unopened and in unused condition.
7.2 In case of returns, the Seller reserves the right to charge the Customer the direct costs of recovering the Products if they are not returned or are returned at the Seller's expense.
8. Warranty and guarantees
8.1 The statutory warranty regulations apply.
8.2. The warranty lies solely with the buyer and is not transferable in the event of resale of the product.
9. Compliance with the warranty conditions
9.1 To be eligible for warranty service, customers must ensure that they meet the specified conditions.
9.2 Regular maintenance and proper use of the product in accordance with the manufacturer’s instructions are mandatory.
9.3 Any unauthorized changes or modifications to the product are prohibited.
10. Liability
10.1. We are liable without limitation in the event of injury to life, body or health, in the event of intentional or grossly negligent breach of duty, as well as in the event of a warranty promise and within the scope of application of the Product Liability Act.
10.2. In the event of a breach of essential contractual obligations due to slight negligence, liability is limited to the damage foreseeable at the time the contract was concluded.
10.3. Any further claims for damages are excluded.
11. Place of jurisdiction
11.1. For all disputes arising from or in connection with these Terms and Conditions or the contracts concluded between the contracting parties, the local court with jurisdiction at the Seller’s registered office in Spreitenbach, Switzerland, shall be the exclusive place of jurisdiction.
